Terms and Conditions of Use for Deezer for Professionals Services

The website admin.deezer-for-professionals.com (hereinafter the "Platform") and the "Deezer for Professionals" application (hereinafter the "Application"), the Platform and the Application being together referred to as the "Services", constitute an intellectual work protected by the provisions of the French Intellectual Property Code and applicable International Regulations. Under no circumstances may the user reuse, transfer or exploit for their own account all or part of the elements or works of the Services.

Use of the Services implies full acceptance of the terms and conditions of use described below. These terms of use are subject to change or completion at any time, and users of the Services are therefore invited to consult them regularly.

The Services are normally accessible to users at all times. An interruption for technical maintenance may however be decided by Deezer, which will then endeavor to communicate the dates and times of the intervention to users in advance. The Services are regularly updated by Deezer. Similarly, the legal notices may be modified at any time: they are nevertheless binding on the user, who is invited to refer to them as often as possible in order to become aware of them.

1. Description of services provided

The Services are intended to provide legal entity users with access to a platform for managing audio content playlists for broadcast within their private or public establishment. This access is strictly conditional on prior subscription to Deezer for Professionals through a contract signed between the user and Deezer. In the event of a contradiction between the provisions of these general terms and conditions of use and said contract, the latter shall prevail.

The Platform does not in any way allow listening, streaming or playback of any audio or video work.

The Services endeavor to provide information as accurate as possible. However, Deezer cannot be held responsible for omissions, inaccuracies and shortcomings in updates, whether they are due to Deezer or to third-party partners who provide this information.

All information provided on the Services is given for information purposes only and is subject to change. Furthermore, the information appearing on the Services is not exhaustive. It is provided subject to modifications having been made since it was posted online.

2. Contractual limitations on technical data

The Services cannot be held responsible for material damage related to the use of the Services. In addition, the user of the Services undertakes to access the Services using recent equipment, containing no viruses and with an updated latest-generation browser.

The Services are hosted by a service provider in the territory of the European Union in accordance with the provisions of the General Data Protection Regulation (GDPR: No. 2016-679). The objective is to provide a service that ensures the best accessibility rate. The host ensures the continuity of its service 24 hours a day, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible periods, particularly for maintenance purposes, improvement of its infrastructure, failure of its infrastructure or if the Services generate traffic deemed abnormal.

Deezer and the host cannot be held responsible in the event of malfunction of the Internet network, telephone lines or computer and telephone equipment linked in particular to network congestion preventing access to the server.

3. Intellectual property and infringement

Deezer and its publisher Deepidoo are owners of each of their respective intellectual property rights and each hold usage rights to all elements accessible on the Services, including texts, images, graphics, logos, videos, icons and sounds. Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Services, whatever the means or process used, is prohibited, except with prior written authorization.

Any unauthorized use of the Services or any of the elements it contains will be considered as constituting infringement and prosecuted in accordance with the provisions of articles L.335-2 and following of the French Intellectual Property Code.

4. Limitations of liability

Deezer cannot be held responsible for direct and indirect damage caused to the user's equipment when accessing the Services, resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or incompatibility.

Deezer also cannot be held responsible for indirect damages (such as, for example, loss of market or loss of opportunity) resulting from the use of the Services. Interactive spaces (possibility to ask questions in the contact space) are available to users. Deezer reserves the right to delete, without prior notice, any content posted in this space that would contravene the legislation applicable in France, in particular provisions relating to data protection. If applicable, Deezer also reserves the right to bring civil and/or criminal liability against the user, particularly in the case of messages of a racist, insulting, defamatory or pornographic nature, regardless of the medium used (text, photograph, etc.).

5. Personal data management

The User is informed of regulations concerning marketing communications, the law of June 21, 2014 for confidence in the Digital Economy, the Data Protection Act of August 6, 2004 as well as the General Data Protection Regulation (GDPR: No. 2016-679).

6. Data controllers

For Personal Data collected in connection with the creation of the User's personal account and their navigation on the Services, the data controllers are Deezer and Deepidoo.

As data controllers for the data they collect, Deezer and Deepidoo undertake to comply with the framework of legal provisions in force. It is particularly the Client's responsibility to establish the purposes of their data processing, to provide their prospects and customers, from the collection of their consent, with complete information on the processing of their personal data and to maintain a processing register consistent with reality. Whenever Deezer or Deepidoo processes Personal Data, they take all reasonable measures to ensure the accuracy and relevance of the Personal Data with regard to the purposes for which they process it.

7. Hyperlinks, "cookies" and internet tags

The Services may contain a number of hyperlinks to other sites. However, https://www.deepidoo.com/ does not have the ability to verify the content of sites visited in this way, and will therefore assume no responsibility in this regard.

Unless you decide to disable cookies, you accept that the site may use them. You can disable these cookies at any time and free of charge using the deactivation options offered to you and recalled below, knowing that this may reduce or prevent accessibility to all or part of the Services.

8. "Cookies"

A "cookie" is a small information file sent to the User's browser and stored within the User's device (e.g.: computer, smartphone) (hereinafter "Cookies"). This file may include information such as the User's domain name, the User's Internet service provider, the User's operating system, as well as the date and time of access. Cookies do not risk damaging the User's device in any way.

Deezer may process the User's information concerning their visit to the Services such as pages viewed, searches carried out. This information allows Deezer to improve the content of the Services and the User's navigation.

If applicable, Deezer declines all responsibility for the consequences linked to the degraded operation of the Services and services possibly offered by Deezer, resulting (i) from the User's refusal of Cookies (ii) from the impossibility for Deezer to record or consult the Cookies necessary for their operation due to the User's choice. For the management of Cookies and the User's choices, the configuration of each browser is different. It is described in the browser's help menu, which will explain how the User can modify their preferences regarding Cookies.

At any time, the User can choose to express and modify their preferences regarding Cookies. Deezer may also use the services of external service providers to help it collect and process the information described in this section.

9. Internet tags

Deezer may occasionally use internet tags (also called "tags", or action tags, single-pixel GIFs, transparent GIFs, invisible GIFs and one-to-one GIFs) and deploy them through a web analytics specialist partner that may be located (and therefore store corresponding information, including the User's IP address) in a foreign country.

This technology allows Deezer to evaluate visitors' responses to the Services and the effectiveness of its actions (for example, the number of times a page is opened and the information viewed), as well as the use of these Services by the User.

The external service provider may collect information about users of the Services and other websites through these tags, compile reports on the activity of the Services for the attention of https://www.deepidoo.com/, and provide other services relating to the use of the Services and the Internet.

10. Applicable law and competent jurisdiction

Any dispute in connection with the use of the Services is subject to French law. Except in cases where the law does not permit it, exclusive jurisdiction is attributed to the competent courts of Paris.
